GENERAL CONTRACTING TERMS AND CONDITIONS

 

Please read these General Contracting Terms and Conditions carefully as they are applicable to any purchase you make through our website. It is not allowed for you to make any purchase through the web until you have confirmed that you have read and accepted these Sale Conditions and the rest of the privacy policies, by ticking the box confirming having read and provided acceptance of the Legal Disclaimer, of the Conditions of use of the web along with the Sale Co nditions that you will be able to peruse prior to confirming any booking or purchase of a voucher.

 

1. PARTIES AND ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS REGARDINGCONTRACTING :

(hereinafter referred to as the General Terms and Conditions orCGC):

 

On the one hand, WECAMP FUTURE, SL which handles accommodation bookings in THE CAMP SITE by selecting the client from the list made available to it or through the sale of vouchers that can be exchanged by stays (accommodation bookings) (hereinafter the service provider or THE CAMP), by dialling the customer care line on 900.056.003 or e-mail: info@wecamp.net, with the ownership of the web pertaining to www.wecamp.net (our web) outlines the contractual document that will govern the contracting of bookings or purchase of vouchers through our website.

 

And the other party, User – Customer ( hereinafter referred to as the User ),

 

BOTH PARTIES ACCEPT this document which entails that the User:

  1. Has read, understands and comprehends what is stated above.

  2. Is a person of legal age holding sufficient legal standing to enter into contracts.

  3. Assumes the obligations set forth herein.

  4. Has read and accepts these general sale conditions for the moment the booking is made or the voucher is purchased.

This document may be printed and saved by Users.

 

The service provider makes the foregoing available through the e-mail info@wecamp.net so that Users may lodge any query tthey have regarding these conditions.

 

These conditions will have an indefinite validity period and will be applicable to all contracting entered into through the above - mentioned website made available by the service provider.

 

The service provider reserves the right to modify of its own accord said General Terms and Conditions, without the foregoing being able to affect bookings, vouchers or promotions that were acquired prior to this mod ification, witth the aim of improving the services offered. In any event, prior to booking, please consult these general conditions.

 

It is advisable to save a copy of the details issued when placing a booking and / or purchasing a voucher

The civil liability of THE CAMP SITE for the services provided is limited to the amount of the same, the user waives the right to claim any responsibility from THE CAMP SITE on any grounds in any case of dissatisfaction with the services through our website, as well as possible failures, slowness vis - à - vis access or errors in accessing the web, including loss of data or other information that may exist on the computer or netw ork of the user accessing the web.

 

THE CAMP SITE makes available to users accommodation rentals to place a booking (hereinafter referred to as the booking) and the sale of vouchers for amounts that adapt to the most economic rates of our accommodation off er in the camp sites and with which the booking can be made post purchase (hereinafter referred to as the voucher) through our website.

 

2. PURPOSE OF THE CONTRACT:

 

2.1 Scope of application: The purpose of this contract is to regulate the contractual relationship of purchase - sale and/or provision of accommodation by the provider at a certain price and booking details, along with payment of the same by the user at the moment in which they accept these booking conditions during the online contracting pro cess by checking the corresponding box.

These CGC will be applicable from the day a booking is placed or a voucher is purchased onwards.

The aforesaid contractual relationship entails the provision of a service, in exchange for a certain price that is publ ished on the website, at the time the booking is placed or a voucher is purchased. 

2.2 Territorial application: The user will be able to place bookings or purchase a voucher through our web, from anywhere worldwide.

 

2.3 Standing to enter into contractsIn order to be able to place a booking, the user must be of legal age and hold standing to enter into contracts. Booking placed or vouchers purchased by underage persons will not be deemed valid without the express authorisation on the part of an adult.

 

2.4 Acceptance on the part of the Customer: The validation of a booking or voucher purchase and subsequent booking on our site will be made via email, and entails, likewise, that the User has previously accepted these CGC. These conditions are published on our website, or should you so wish, we can send them to you by electronic mail.

 

2.5. Modification of the General Terms and Conditions: THE CAMP SITE reserves the right to make changes and / or modifications to these CGC at any time. We advise our custo mers to review them regularly. In the event that these changes or modifications were inserted once the booking is placed or a voucher is purchased, the conditions in force at the time in which said booking / purchase was made will be applicable.

 

3. INFORMATION SUPPLIED ON OUR WEBSITE:

 

3.1 Publication of prices: The prices of accommodation on offer are those displayed at the time when the booking is started on our web

The prices of vouchers will be those displayed for each one of these at any time on our web.

 

3.2 Information on accommodation and vouchers: The information that appears in our advertising, brochures, other written material, on our website or that provided to you constitutes an invitation to make a booking, yet und er no circumstances does reading or consulting or simply visiting our website imply a commitment or obligation to make a booking or purchase a voucher The contents on our website are constantly being updated and updated to offer our clients the most compl ete and detailed information and can be consulted in Spanish, Catalan, French and English. Communications with customers and users, as well as the formalisation of contracts, will be carried out in the language the customers wishes to use, always indicatin g this prior to commencing the contracting process.  

 

3.3 Availability of the accommodation offer: The accommodation offer published on the web at any time, will correspond to those which are available. In the event that the accommodation becomes unavaila ble, it will not appear as published on the website.

 

3.4 Bookings for the opening period at the CAMP SITE: The reception opening hours for web bookings, made for the opening period at the Camp Site (period notified of on the page of each available camp si te on the web) are operational twenty - four (24) hours a day, 365 days per year. Once the booking has been placed, the User will automatically receive an email confirming the process and another to confirm the purchase once the service provider has received and confirmed the payment corresponding to the amount for the same.

The opening hours for reception and the customer service line while the camp site is open is from 9:00h to 22:00h.

 

3.5 Fraud: If the CAMP SITE suspects or detects any anomaly or fraudulent use, it reserves the right to annul the booking or voucher purchase on the grounds of security.

 

4. BOOKING AND / OR PURCHASE PROCEDURE:

In order for the user to access the services offered by the provider, that is, make a booking or purchase a voucher, it will not be necessary to register through our website by creating a user account, though the User will only be asked to provide the essential data to be able to process their booking.

In compliance with art icle 27 of Law 34/2002 on the Information Society and e - Commerce, the CAMP SITE, prior to initiating the booking process or voucher purchase, makes the following information available in a clear, understandable and simple manner:

 

Booking accommodation

Onc e the accommodation(s) that you wish to book has / have been selected, the booking procedures will involve the following steps:

  1. You must choose the camp site, the dates of the stay and the number of people, then click on consult. Available accommodation wi ll appear and you can chose the rental you wish by clicking on select, this tehn being added to your cart so that you may process the booking.

  2. The confirmation of the purchase will be displayed (summary of the booking made, your details, the booking amount and the means of payment).

Certain personal details will be requested in order to carry out the booking. We will record your details in our database and these will be stored while the commercial relationship, and subsequently, until the expiration of our responsibilities. Additionally, you will be asked to provide your consent to store your data for longer so that we can continue to send you sales information on new launches, services or any other information that we consider may be of interest to you.

 

Spam and unsolicited mail folders must be checked in your inbox while always verifying that the contact details you have provided are correct.

  1. Once you have provided your details, along with the total amount of the booking, there is a verification check bo x that you must tick as acceptance of these General Contracting Clauses and the Legal Notice posted on our website.

  2. To end the process, you must click on the button, Place booking.

 

Voucher purchase

Once the voucher that you wish to book has been selected , the purchasing procedures will involve the following steps:

  1. Choose the voucher for the amount desired and click on it. This will be added to your cart and you will be able to process the purchase.

  2. The confirmation of the purchase and certain personal dat a will be requested so that you can carry out the purchase. We will record your details in our database and these will be stored while the commercial relationship, and subsequently, until the expiration of our responsibilities. Additionally, you will be as ked to provide your consent to store your data for longer so that we can continue to send you sales information on new launches, services or any other information that we consider may be of interest to you.Once you have provided your details, along with th e total amount of the booking, there is a verification check box that you must tick as acceptance of these General Contracting Clauses and the Legal Notice posted on our website.

  3. The user must verify always that the data they have provided are correct and the latter assumes full liability for the act of entering false or erroneous data.

  4. To complete the process, you must click on the button Complete purchase.

 

In any event, the service provider will inform the user once the purchase process has been concluded, sending a mail detailing

  • If the contracting involves booking accommodation: all characteristics, prices and payment in the establishment, date contracted and booking dates.

  • If the purchase involves a voucher, the stays that can be booked with t his, its expiry date and the link to place the booking and exchange the voucher for a stay.

 

If there was any type of mistake in the address indicated or any other point regarding the booking, you must inform us of this immediately at the email address giv en in the website as to remedy the mistake.

 

Should you have any doubts, you may contact our Customer Care Service via any of the methods stated on our web.

 

THE CAMP SITE offers a FREE Customer Care Service through our contact emai info@wecamp.net or by dialling 900.056.003, should the User choose an alternative means of communication, the latter must bear any specific costs arising from this.

 

5. CONFIRMATION OF THE BOOKING / PURCHASE:

When finalising the online purchase, we will send you confirmation of the booking to the email address you have provided to place the same.

We would advise you that, should you not receive the aforesaid email, you check whether it has been delivered to your spam or unsolicited mail folder.

The payment of the booking for the stay will be made at the establishment, 7 and 3 days prior to your arrival. Reminder emails will be sent.

They payment of the voucher will be made by card on the website. Once the purchase process is completed, yo u will receive a confirmation email.

 

If there is any error in the data or you have not received the confirmation mail, you must immediately contact our Customer Care Service on 900.056.003 or send an email to info@wecamp.net, to be able to reach a suitable rectification.

 

6. RICES AND VALIDITY PERIOD FOR SPECIAL OFFERS:

All prices displayed on our website include VAT in force at the time the booking / purchase was made. All prices stated on our website are valid and are expressed in euros.

 

The invoice for the booking will be sent to User personally when the payment is made.

The invoice for the purchase of the voucher must be requested at info@wecamp.net

 

The prices applicable to each accommodation rental and voucher will be published on the website and applied automatically during the contracting process in its final stage.

 

In the event of special promotions of limited duration, the promotion's discount will be applied whenever the booking has been placed during this promotional period.

 

The data recorded via the different payment methods constitute proof of the date in which the financial transactions were carried out and will serve to determine whether said booking is eligible for a promotion or not.

 

For further information on the booking / purchase process, the User may contact the service provider's customer care service via telephone or at the email address provided.

 

7. MEANS OF PAYMENT:

During the web booking pro cess, the credit or debit card details are required as guarantee for the booking: The User must hold a valid credit or debit card, in which all the card's numbers must appear, along with the expiry date and name of the cardholder in the corresponding onli ne form. The transaction will be formalised when the booking is made. Only payments with secure cards that are with authentication of your identity as the cardholder in accordance with the methods established by your bank for e - commerce transactions will b e accepted ("Verified by Visa" and "MasterCard SecureCode"). The booking will not be recognised and thus not be processed until payment has been authorised by your bank or building society.

he system name SSL (Secure Sockets Layer) is used as this paymen t system takes places within a secure environment that allows for the information given to be encryped during the transaction process, thus guaranteeing the confidentiality of the same.

 

Once the user arrives at the establishment, they will be charged the full amount of the booking made via credit or debit card. 

Should cancellation take place outside the established period with charges liable to the user owing to a 'no - show', collection will be made through the credit or debit card indicated in the booking.

 

Voucher purchase, this will be paid for using a credit or debit card: The User must hold a valid credit or debit card, in which all the card's numbers must appear, along with the expiry date and name of the cardholder in the corresponding online form. The transaction is formalised when the order is placed. Only payments with secure cards that are with authentication of your identity as the cardholder in accordance with the methods established by your bank for e - commerce transactions will be accepted ("V erified by Visa" and "MasterCard SecureCode"). The order will not be recognised and thus not be processed until payment has been authorised by your bank or building society.

In this regard, and for security reasons, we will not have direct access to users' ba nking dettails. These data and payments made by card will be handled directly by our banking services.

 

  1. CANCELLATION TERMS AND PAYMENT:

The right of withdrawal from the Booking does not apply according to the exception provided for in article 103 l) of Ro yal Legislative Decree 1/2007, dated 16 November, which approves the recast text of the General Law for Defence of Consumers and Users and other complementary GENERAL CONTRACTING TERMS AND CONDITIONS laws, as it is the provision of accommodation services for purposes other than serving as housing if the contracts provide for a specific date or period of implemenatation. No voucher may be refunded, cancelled or exchanged for its cash value once it has been purchased.

 

It may be cancelled freely before 00:00 hours on the day prior to starting the bo oking. From this point onwards, if you cancel, the first night will be charged to your card.

Should you make a booking using a voucher, you may request a change of date for free providing your chosen camp site has availability.

 

If the accommodation booked is not occupied on the day of arrival, or at the latest by 12 o'clock on the next day, your booking will automatically be cancelled, unless you have informed us in writing of your delay. No refund will be given if you are delayed in arrival or have to lea ve early.

 

  1. DATA PROTECTION:

You can find the information relating to protection of your personal data, as well as how to exercise the rights you hold in relation to their processing in the Legal Notice on our website.

 

  1. SALES COMMUNICATIONS:

We may use, in t he event that you give us your express consent, or in the event that you have not yet specifically provided it and have made a booking or purchased a voucher, your email address to send you commercial information regarding our services and news items, as p art of our customer services for the duration of our business relationship. Once this is finalised, we will only send you sales information if you have given us your express consent.

The User may de - register from this service at any time and thus no longer receive any sales information by sending an email to info@wecamp.net with your request.

 

  1. CONDITIONS AFFECTING THE STAY AND VOUCHER

CONDITIONS AFFECTING THE STAY

The accommodation may be occupied on the day of arrival from 15:00 h onwards and must be vacated on the day of departure before 12:00 h in the morning.

 

The plot may be occupied on the day of arrival from 13:00 h onwards and must be vacated on the day of departure before 12:00 h in the morning. Only one arbour may be placed, and the installation of any kind of additional separating fence to those provided by the camp site is not permitted.

The installation of tents, caravans and vehicles may only be carried out during the opening hours of reception and s olely in areas designated by management. Changes of location must be authorised.

 

Tourist taxes, when appropriate, will be applied in accordance with the legislation in force and will be paid in the CAMP SITE reception upon arrival.

 

Pets are admitted in the CAMP SITE, except in bookings for cabin tent and couple glamping. The entry of animals who present a clear danger or bother other campers is wholly prohibited in the camp site. They will always be kept on a leash, within the limits of your plot, with th eir owners being liable for them at all times.

 

Once the booking has been formalised, Management undertakes to book the number of accommodation places or plots requested, without being able to guarantee their exact number. The booking solely confers the ri ght to occupy an undetermined place and does not confer any other priviliges. 

 

The service provider will not be held liable for mistakes in the booking attributable to the User or caused by unavoidable and extraordinary circumstances.

 

Extra services:

If t he USER is interested in contracting an extra service, they must select this when placing the booking where they will see the conditions and price of this service.

 

Customer responsibilities:

The USER undertakes to:

  • Respect the regulations in force at the Camp Site detailed in the internal code of conduct that will be provided to them in reception and detailed in these conditions in this clause.

  • During the hours of rest, from 24:00h to 8:00h, it is forbidden to use the accommodation to host parties, make no ise or drive around the facilities. Under no circumstances is it allowed to occupy a plot or accommodation with more people than the amount established in its maximum capacity.

  • The pool opening hours are from 09:30 a 19:30. It is forbidden to fix objects s uch as sunshades, awnings etc, in the lawns, along with the use of inflatable air mattresses in the pool.

  • Children must always be accompanied by their parents and under the latter's responsibility.

  • The USER is liable for the proper behaviour of all their b ooking companions, otherwise, the SERVICE PROVIDER reserves the right to expel the occupants from the accommodation, without the right to future claims or any type of compensation.

  • THE CAMP SITE will not be held liable for any direct or indirect damages th at might be caused as a consequence of the misuse of the accommodation, including, without any limitation, serious damage, loss due to fire, theft, delinquency, accidents or any other type of damages.

  • Entry to the camp site is reserved exclusively to campers. In exceptional circumstances, Management, at the request of the customer and under the latter's liability, may authorise the entry, always for a set limited time, of relatives and friends who are obliged to display their identification document in any event. Once the set time has elapsed, this will entail that the visitor will be considered as a customer for a day, for all legal purposes. The same will occur if the visitor made use of the any Camp Site service.

 

Recommendations:

  • To streamline exits and entries and avoid unnecessary waits, please pay for your stay on the afternoon before your departure.

  • We would ask you to make rational use of water and the facilities, as well as the surroundng enviornment.

Prohibiciones:

  • Disturbing the rest of other resi dents and / or undertaking activities that might bother other campers.

  • Undertaking activities that might bother other campers.

  • Misuse of water.

  • Bringing in non - guests without authorisation from Management.

  • Causing damage to plants, trees or camping facilities.

  • Opening or handling electrical supply cabinets in the plots. Should there be a malfunction, please report it to reception.

  • It is forbidden to use televisions, radios or musical instruments at volumes that exceed limits and may bother other residents.

  • Lighting barbecues or log fires inside or outside the camp site (Expressly forbidden by the Environmental Agency)

 

The service provider will not be held liable for mistakes in the booking attributable to the User or caused by unavoidable and extraordinary circumstances.

 

At the CABO DE GATA camp site, aside from what has been stated in this section, the following regulations will be enforced: In the event of specific conditions, the regulation s of the actual camp site will prevail:

 

The Customer undertakes to respect the camp site detailed in this clause and also available in reception:

 

  • Under no circumstances is it allowed to occupy a plot or accommodation with more people than the amount established in its maximum capacity.

  • During the pool's open ing hours, children must be accompanied by a responsible adult. Under age minors will be under the tutelage of their parents / legal guardians.

  • The use of inflatable air mattresses inside the pool nor glass recipients is not permitted in the entire pool ar ea.

  • Pets must be kept on a leash at all times..

 

Prohibitions:

  • Smoking and lighting candles inside the accommodation.

 

VOUCHER CONDITIONS

The voucher expires after 12 months counting from the day it is purchased.

The voucher may be exchanged in any of the camp sites featuring availability on the WECAMP website, and for the amount corresponding to the voucher purchased.

On the website, each voucher contains the information corresponding to stays with which the customer - user or its beneficiary can make the booking. The booking process will be via the link that you have received in the confirmation email. You may also place a booking via the web, indicating at the time you make the booking that you have a gift voucher or stating the identification number of t he same.

The identification number is shown on the voucher he consumer - user receives in the confirmation email. We will send you this along with the confirmation of your purchase by email. This booking receipt will be what you mus show at he camp site up on your arrival on the specified date

The total value of the voucher must be used in a booking, We offer vouchers for amounts that suit more economical rates. The vouchers may only be exchanged for the booking of accommodation. Other services such as the restaurant, activities, experiences or merchandising are not included.

La persona que compra el bono no tiene por qué ser el beneficiario del mismo, puede regalarlo. 

The person who purchases the voucher does not need to be the beneficiary of the same. Once the booking has been made, all the conditions set forth in this document will be duly applicable.

WECAMP is not liable for lost vouchers.

 

  1. ANNULMENT AND INEFFECTIVENESS OF THE CLAUSES:

If any clause included in these General Conditions were declared, totally or partially, null or ineffective, such nullity or ineffectiveness will affect only said p rovision or the part of it that is null or ineffective, subsisting the General Conditions in everything else, taking said disposition, or the part of the same that is affected, deemed not included.

 

  1. RESOLUTION OF DISPUTES ON LINE (ONLINE DISPUTE RESOLUTION):

In accordance with Article 14.1 of Regulation (EU) 524/2013, issued by the European Commission facilitates a free access platform in which conflicts arising between the USER and the SERVICE PROVIDER can be resolved without the need to turn to the courts of justice, through the intervention of a third party , named the Lawsuit Resolution Body (ODR) , which acts as an intermediary between both parties. This body is neutral and will dialogue between both parties to reach an agreement, being thus ab le to suggest and / or impose a solution to the dispute.   1. APPLICABLE LAW AND JURISDICTION:

These conditions will be governed and interpreted in line with Spanish Law in whatsoever is not expressly accounted for herein. In the absence of what is established in the previous clause, the provider and the user agree to submit any dispute that may arise from the provision of the service subject to these Conditions, to the Courts and Tribunals of the provider's domicile (if the user is not considered a consumer for the purposes of the TRLGDCU) or the user (if the user is considered a consumer for the purposes of the TRLGDCU).

 

  1. APPLICABLE LEGISLATION:

Thes e General Terms and Conditions are subject to the provisions of:

European legislation regulating e - commerce:

  • Directive 97/7/CE relating to the protect ion of consumers in matters of distance contracts (Distance Sales Directive);

  • Directive 2000/31/CE rrelating to certain legal aspects for information society services, specifically with regard to e - commerce in the interior market (Directive on e - commerce).

 

Spanish legislation:

 

  1. LANGUAGE: 

These sales conditions have been originally drafted in Spanish. Should there be any contradiction between one version in Spanish and another in a diferent language, the text in Spanish shall prevail.
